GRADS PHOTO CONTEST
These are the Official Rules for the Times Publishing Company’s Grads Photo Contest, starting May 28, 2009 and ending June 11, 2009, EDT. Entering a photo in the Contest constitutes the full and unconditional agreement of each Entrant to these rules, terms and conditions.
Eligible Entrants are legal residents of the United States and Florida who
are at least 18 years of age at the time of entry and who reside in one of
the following Florida counties: Hillsborough, Pasco, Pinellas, Hernando,
Polk and Citrus. The person who submits the Contest entry is “the Entrant” for purposes of these rules.
The Entrant must (1) be the person pictured in the photo, (2) have the express permission of each person in the photo to enter it into the Contest if such persons are age 18 or over, and/or (3) if a person in the photo is under 18, be the person’s parent or legal guardian, or have the express permission of the person’s parent or guardian, to enter the photo in the Contest. In addition, each Entrant must either be the author of the photo or have the express permission of the author to submit the photo to the Contest. By entering a photo in the Contest, each Entrant represents, warrants and affirms that he or she meets these eligibility conditions. Entries found to violate any of the conditions of eligibility will be disqualified.
Entry into the Contest and being declared the Winner cannot violate any then-existing intellectual property rights, rights of publicity, or contractual obligation of Entrant or any third party,
or else the Entry is void. By uploading or emailing a photo to the Contest, each Entrant agrees to indemnify and hold harmless the Times Publishing Company of and from any claims, demands or damages, including those for copyright or other intellectual property infringement and/or breach of
contract, arising from the entry into or participation in the Contest.
Employees of the Times Publishing Company, its affiliates and subsidiaries,
advertising and promotion agencies, contest prize suppliers, and
participating advertisers and their immediate family members are not
eligible to enter or win. “Immediate family members” means parents,
siblings, spouses, children, grandparents and grandchildren, whether by
current or past marriage, remarriage, adoption or cohabitation, and anyone
living in the same household, whether related or not.
Times Publishing Company’s determination as to eligibility is final and binding
HOW TO ENTER
There are three ways to enter contest. Entrants may submit one or more photos by any of the following methods: (1) E-mail pictures to email@example.com with details about each photo, including the graduate's name, and contact information for both the Entrant and the graduate pictured (including telephone number with area code & e-mail address, not for publication) in the body of the message. Files must be JPEGs and less than 700K in size. (2) Join tampabay.com's Community Photo Gallery and upload photos, with details about each photo, including the graduate's name (and contact information including telephone number with area code & e-mail address, not for publication) in the caption area. 3) Become a tampabay.com Facebook fan and share photos on our wall, clearly labeling it as a "Grad Photo Contest" entry and including the grad's name. We will then re-publish the photo(s) in our Grads Photo Gallery. Photos must be submitted by Thursday, June 11, 2009 at 11:59 p.m. Eastern Daylight Time to be eligible to win.
Incomplete entries may be published in the Grads Photo Gallery but will be
ineligible to win. The odds of winning depend on the number of eligible
entries received and the number of voters participating.
The Times Publishing Company is not responsible for lost, late, incomplete,
misdirected, damaged or illegible entries or for any computer, electronic,
telephone, cable, or network hardware or software malfunction or failures
of any kind, or for any other problems or errors in modes of transmission,
or for any other human or technical error.
All entries become the property of the Times Publishing Company. Each
Entrant acknowledges and agrees that the Sponsor may use information
submitted to contact entrant and/or to offer Sponsor’s products or
HOW TO WIN
Two (2) Winners will be selected. One (1) Winner will be selected by St. Petersburg Times editors based on the photo's creativity, style and technical merit. The second Winner will be selected by the highest total of valid reader votes, as tallied electronically in accordance with the following. Starting on May 28, 2009 at 9 a.m. EDT, readers may vote for their favorite photo by clicking on the voting tab below that photo in the Grads Photo Gallery. Voting ends on June 11, 2009 at 11:59 p.m. EDT.
Valid votes received by the Sponsor between the times stated above will be
counted. Times Publishing Company and its affiliates are not responsible
for late, lost, incomplete, misdirected, garbled, jumbled, illegible or
ineligible votes or for any computer, online, telephone, cable, network,
electronic or Internet hardware or software malfunctions or failures, or
any human or technical error that may occur.
The use of any scheme, program or device to automate voting is
prohibited. Any attempt by any voter to tamper with or undermine the
legitimate operation of the Contest or tally of votes will, in the
Sponsor’s sole discretion, result in the disqualification of the
Entrant and any suspect votes. The Sponsor reserves the right to
disqualify any entrant or vote, to modify, cancel, terminate or suspend
voting or the Contest. Decisions of the Sponsor are final and binding.
There will be two (2) winners of the Contest, each of whom will receive one of the two Prizes. Each Prize is a $200 gift certificate redeemable for merchandise at any participating IKEA location. The Prizes are furnished by IKEA. Restrictions imposed by the retailer may apply. Prizes are not redeemable for cash. No other alternative prize or substitution is permitted, except that in the event of prize unavailability, Sponsor reserves the right to substitute a prize or prizes of equal or greater value. Winner should allow up to two weeks for delivery of the Prize.
Any transportation required for the Winner to take possession of or make use of the Prize is the Winner’s responsibility and will not be furnished by Sponsor. Any applicable federal, state or local taxes or license fees are the responsibility of the winner(s), who must complete W-9 tax forms upon request by the Times Publishing Company prior to receiving or taking
possession of the Prize. Winners must agree to hold the Sponsor harmless
from any and all liability for damages or losses of any nature incurred
during transit to and from any destination in connection with the gift or
Prize. For purposes of this waiver and release, “Sponsor(s)” includes Times
Publishing Company and its parents, subsidiaries, affiliates, officers,
directors, agents and employees.
NOTIFICATION OF WINNERS
The Winners will be selected on Friday, June 12, 2009 and notified by email and/or phone.
If a Winner does not respond to the notification within forty-eight
hours, or a Winner does not meet all eligibility requirements, an
alternate Winner will be selected. The Winner must produce adequate proof
of identity, such as a driver license or photo I.D. card, in order to take
possession of the prize.
AFFIDAVIT AND RELEASE
The Winner will be required to sign and return an Affidavit of Eligibility
and General Release, which includes an affirmation of eligibility, a
release and waiver of legal claims, and a consent to publicity. Failure to
complete and sign the Affidavit of Eligibility and General Release will
result in disqualification of the entry and selection of another Winner.

ADDITIONAL TERMS AND CONDITIONS
All federal, state, and local laws and regulations apply. Void where
prohibited by law. By entering the Contest, the entrant, for him/herself
and for his/her heirs, executors, administrators, assigns and anyone else
claiming by or through him/her, waives, covenants not to sue and fully
releases and forever discharges any and all rights, claims or causes of action
whatsoever that he/she may have against Sponsor arising directly or
indirectly out of entrant’s participation in the Contest. For purposes of
this waiver and release, “Sponsor” includes Times Publishing Company and
its parents, subsidiaries, affiliates, officers, directors, agents and
employees. This waiver and release covers, without limitation, any damage,
liability, cost, attorneys’ fees and expenses whatsoever, whether known or
unknown and whether foreseeable or not.
Sponsor reserves the right to make changes in the rules of the contest,
including the substitution of a prize of equivalent value, which will
become effective upon announcement.
Sponsor is not responsible for typographical or other errors in printing,
the offering, or the administration of the contest or in the announcement
of the prize.
The Sponsor of the Contest is Times Publishing Company,

written Contest rules will be sent by mail request if request is
accompanied by a self-addressed, stamped envelope.
