These rules are for the Times Publishing Company / Dolphin Tale Contest (“the Contest”), starting August 14, 2011 at 8 a.m. Eastern time and ending September 4, 2011 at 5 p.m. Eastern time. Entry into the contest constitutes the entrant’s full and unconditional agreement to and acceptance of these rules, terms and conditions.

ELIGIBILITY: NO PURCHASE IS NECESSARY TO ENTER OR WIN. Purchase will not improve chances of winning. The Contest is open to legal United States residents of Pinellas, Hillsborough, Citrus, Pasco, Hernando and Manatee counties in the state of Florida who are 18 years of age or older at the time of entry, except employees of the Times Publishing Company, its affiliates and subsidiaries, advertising and promotion agencies, contest prize suppliers, and participating advertisers and their immediate family members are not eligible to enter or win. “Immediate family members” means parents, siblings, spouses, children, grandparents and grandchildren, whether by current or past marriage, remarriage, adoption or cohabitation, and anyone living in the same household, whether related or not. Times Publishing Company’s determination as to eligibility is final and binding.

HOW TO ENTER: Entries may be submitted online at The entry form must be completed in its entirety. Only one entry per person per household is permitted. The odds of winning depend on the number of eligible entries received. The Times Publishing Company is not responsible for lost, late, incomplete, misdirected, garbled, jumbled, damaged or illegible entries, for any computer, electronic, telephone, cable, or network hardware or software malfunction or failures of any kind, for any other problems or errors in modes of transmission, or for any other human or technical error. Deadline for receiving entries is September 4, 2011 at 5 p.m. All entries become the property of the Times Publishing Company.

PRIZE: The following Contest prizes will be awarded. One Grand Prize consisting of: Four (4) VIP tickets for the Red Carpet Screening of the movie Dolphin Tale on September 21, 2011 at Ruth Eckerd Hall. Plus, a special encounter with Winter the dolphin at Clearwater Marine Aquarium for a group of four (4). Three Runner-Up Prizes consisting of: Four (4) admission tickets for the Clearwater Marine Aquarium and a special gift basket. Value of the Grand Prize Package: $3,000. Value of each runner-up prize will be $134.80. Total Value of All Prizes: $3,404.40.

PRIZE RESTRICTIONS: Only one prize per household. Prizes are non-transferable or assignable by the Winner and have no cash value. All winners must execute a declaration of eligibility and release as described below. Winners are responsible for any charges not specifically listed as part of the prize, including but not limited to meals, telephone calls, transportation, parking, gratuities, and incidentals. Prizes are not redeemable for cash and may not be extended, transferred or substituted, except that Times Publishing Co. and the Clearwater Marine Aquarium may substitute a prize or prizes of equal or greater value when necessary, as determined in their sole discretion. No alternative prize, cash or other substitution is permitted except that in the event of prize unavailability. Winner should allow up to one week for delivery of the prize. All federal, state and local taxes and fees, including title and transfer fees, and insurance are the responsibility of the Winner. The Winner agrees to pay all such taxes and fees and is responsible for furnishing proof of insurance if and as required by law. Winner must complete a W-9 tax form provided by the Times Publishing Company prior to taking possession of the Prize. Any transportation required for the Winner to take possession of the Prize is the Winner’s responsibility and will not be furnished by the Sponsor. Winner must agree to hold the Sponsor harmless from any and all liability for damages or losses of any nature incurred during transit to and from any destination in connection with the Prize.

NOTIFICATION OF WINNER: The Winner will be selected in a random drawing and notified by phone, using the information on the entry form, on September 7, 2011. If the Winner does not respond to the notification within forty-eight (48) hours, or the Winner does not meet all eligibility requirements including signing the Affidavit and Release referred to below, an alternate winner will be selected by random drawing. Alternate winners are subject to all requirements and limitations in these Official Rules.

AFFIDAVIT AND RELEASE: The Winner will be required to sign and return a notarized Affidavit of Eligibility and General Release, which includes an affirmation of eligibility, a release and waiver of legal claims, and consent to publicity. Failure to complete and sign the Affidavit of Eligibility and General Release will result in forfeiture of the prize and its award to another winner chosen by random drawing.

WINNERS’ LIST: For a list of prize winners, send a self-addressed stamped envelope before September 30, 2011 to: Dolphin Tale Contest Winners, St. Petersburg Times, P.O. Box 413, St. Petersburg, FL 33731-0413.

ADDITIONAL TERMS AND CONDITIONS: All federal, state, and local laws and regulations apply. Void where prohibited by law. By entering the Contest, the entrant, for him/herself and for his/her heirs, executors, administrators, assigns and anyone else claiming by or through him/her, waives, covenants not to sue and fully releases and forever discharges any and all rights, claims or causes of action whatsoever that he/she may have against Sponsor arising directly or indirectly out of entrant’s participation in the Contest. For purposes of this waiver and release, “Sponsor” includes Times Publishing Company and its parents, subsidiaries, affiliates, officers, directors, agents and employees. This waiver and release covers, without limitation, any damage, liability, cost, attorneys’ fees and expenses whatsoever, whether known or unknown and whether foreseeable or not. Sponsor reserves the right to make changes in the rules of the contest, including the substitution of a prize of equivalent value, which will become effective upon announcement. Sponsor is not responsible for typographical or other errors in printing, the offering, or the administration of the contest or in the announcement of the prize.

Copies of the written contest rules are available at the Times main office located at 490 First Avenue South, St. Petersburg, FL during normal business hours (Monday – Friday, 9 a.m. – 5 p.m.) and will be sent by mail request if request is accompanied by a self-addressed, stamped envelope.
